JAIPUR: Rajasthan home minister Gulab Chand Kataria on Monday admitted that nearly 40% of the criminal cases filed in the past one year in the state were found to be fake following which a final report had been filed in them.
Replying to allegations by Congress MLA Ghanshyam about police deliberately filing final reports (FRs), Kataria said that a criminal case would be filed against the officer who is found to be doing so.
“If the department comes across any such complaint about a wrong FR being filed deliberately by a police officer, stringent action would be initiated after a probe,” said Kataria while replying to Ghanshyam’s starred question.
Kataria in his reply said that in 2014, 1,154 first information reports had been filed in Todabheem of which final report was filed in 481 cases. “Challans have been issued in 622 cases and only 51 cases are pending,” he said.
The Congress legislator alleged that the police and administration worked hand-in-glove with anti-social elements and deliberately filed false FRs. “In my constituency, FRs have been filed in over 50% cases. How is that possible? The police work in tandem with culprits and make common man suffer. Those who had submitted their arms during elections are yet to get them back and the police are making them run from pillar to post,” alleged Ghanshyam.
He added that the police were not only harassing them but were demanding money for release of their licensed weapons. The minister asked the members to provide details so that he could check the matter.
As the legislator continued to raise objections, Kataria pointed out that the crime rate in Todabheem had risen by 11.5% in 2012-13 when the Congress was in power while after the BJP came to power, the crime rate had increased by only 4.5%. “Across the state, FRs are filed in 39.7% of the cases while in Todabheen FRs have been filed in 41% cases,” he said.
BJP MLA Madan Rathore raised a query about action taken against fake cases to which Kataria said action is ensured against the complainant under Section 182 of CrPC. “However, we do not get as much support as required from the courts and of the 500 cases that we pursue, we get relief in only three cases. This means wasting lot of time,” said Kataria.
Senior BJP legislator Ghanshyam Tiwari too raised a query regarding cases where FR had been filed even when the accused were themselves boasting about having possession of stolen goods. “We have proofs in such cases. Would you reopen the case?” asked Tiwari.
Kataria asked him to provide details and assured he would look into it.
