NEW DELHI: Terming it “premature”, the Delhi high court on Tuesday dismissed AAP leader Somnath Bharti’s plea challenging the NHRC order on the controversial midnight raid early this year. Justice V K Shali said that since National Human Rights Commission has agreed to hear Bharti and is expected to give its decision on January 13, 2015, the writ can’t be heard at this state. NHRC will give its verdict on Bharti’s argument before it that the commission’s September 29 order should be recalled as it was passed without hearing him.
“I do not agree with the counsel (for Bharti) that the present writ petition is maintainable. In fact, September 29 order is under scrutiny before NHRC. It shows that NHRC has considered the submissions made by the petitioner here and has fixed for order on January 13.
