CHENNAI: Taunt and demand from advocates notwithstanding, a division bench of the Madras high court on Tuesday refused to rescue itself from hearing a public interest litigation opposing a new list of nine names recommended by the court for appointment as judges of the court.
Within a week after the high court forwarded the list of names, the Madras High Court Advocates Association (MHAA) filed a PIL saying the court had ignored eligible candidates from unrepresented and under-represented sections of the society and that certain castes had yet again be over-represented.
On Tuesday, when the matter came up before a division bench of Justice V Ramasubramanian and Justice P R Shivakumar, counsel for the petitioner requested the bench not to hear the matter as certain specific portions of the PIL related to appointment of Brahmin candidates and that the judge leading the bench too was a Brahmin. So, the bench shall not hear the matter, he said.
To this, a composed Justice Ramasubramanian said a similar plea made by advocates in writing was rejected by Chief Justice Sanjay Kishan Kaul. Also, the case was specially posted before the present bench for hearing.
Counsel Muthuramalingam then requested adjournment of the hearing by two weeks, as Bar leaders were in New Delhi in connection with the issue.
