MBA student moves SC for CBI probe in her rape case

imagesNEW DELHI: An MBA student of Hissar-based Jindal Global University, who was allegedly raped by her seniors, has approached the Supreme Court saying police were trying the protect the accused at the behest of a Haryana MP and sought that the case be handed over to CBI.

The 21-year old 2nd year student of integrated BBA/MBA course alleged that she was blackmailed by seniors who took her nude photographs and forced to her to get into physical relationship with them. She was allegedly repeatedly raped on the campus and outside by three seniors who had threatened to circulate the pictures in public.

Senior Advocate Indira Jaising and advocate Devdutt Kamath mentioned the petition before a bench of Justices A K Sikri and U U Lalit, which agreed to hear her plea on May 25.

Jaising pleaded for urgent hearing saying that police were destroying electronic evidence like laptops and mobile phones through which photographs were shared by the accused with other students. She claimed the SHO, who registered the FIR, was transferred under political pressure the very next day.

“The petitioner has been blackmailed, criminally intimidated and horrific crimes of rape and unnatural sex committed upon her by the respondent who circulated and distributed nude pictures of the petitioner from his mobile phone through WhatsApp to students of the university,” she said.

“The state authorities have behaved in an extremely causal, lackadaisical, unprofessional and biased manner leading to valuable evidence being possibly destroyed by the accused persons due to the inability of the prosecution to properly protect and preserve the incriminating evidence,” the petition said.

“The petitioner is constrained to approach this court praying for transfer of investigation to CBI because of shoddy/reckless/biased/mala fide investigation conducted by police, which together have resulted in severe curtailment of her right to live with human dignity, free from any kind of exploitation,” Jaising said.
